1. Acceptance of Terms
By accessing or using GiftLoop, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.
2. Description of Service
GiftLoop is a platform that enables users to:
- Create gift loops (wishlists) for birthday celebrations and special events
- Share gift loops with friends and family
- Receive monetary contributions toward wishlist items
- Track contributions and manage gift loops
Important: GiftLoop is a for-profit service. Contributions are not donations and are not tax-deductible.
3. User Accounts
Eligibility: You must be at least 18 years old to create a GiftLoop account.
Child Data Protection: Parents manage all pages. We don't knowingly collect children's personal data. All information about children on gift loops is provided and controlled by parents or guardians who are 18+.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Accurate Information: You agree to provide accurate and complete information when creating gift loops and making contributions.
4. Fees and Payments
Service Fee: GiftLoop deducts a 7% service fee from each contribution to cover payment processing costs and platform operations.
Payment Processing: Payments are processed securely by our payment processing partners. By making a contribution, you agree to the applicable payment processor's terms of service.
Fee Transparency: Contributors are charged exactly the amount they select. The 7% service fee is deducted from that amount, never added on top, and the remaining 93% is credited toward the recipient's GiftLoop.
Non-Refundable Fees: The service fee is non-refundable, except as required by law or outlined in our Refunds & Disputes policy.
5. Fund Distribution
Payout Schedule: Funds raised through a GiftLoop will be released to the creator after the event date specified in the gift loop.
Minimum Threshold: There is no minimum funding threshold. You will receive the total amount contributed, regardless of whether you reach your goal.
Payout Method: You must provide valid payout account information (Stripe, PayPal, or bank transfer details) to receive funds.
Use of Funds: You are responsible for using contributed funds to purchase the gifts or experiences listed in your gift loop. GiftLoop is not responsible for how funds are ultimately used.
6. User Conduct
You agree not to:
- Create fraudulent or misleading gift loops
- Use GiftLoop for any illegal purpose
- Harass, abuse, or harm other users
- Attempt to gain unauthorized access to our systems
- Violate any applicable laws or regulations
- Misrepresent your identity or affiliation
7. Content Ownership and License
Your Content: You retain ownership of all content you create on GiftLoop (stories, photos, descriptions, etc.).
License to GiftLoop: By posting content, you grant GiftLoop a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content as necessary to provide the service.
Content Standards: All content must be appropriate for all ages and comply with our community guidelines.
8. Prohibited Activities
The following activities are strictly prohibited:
- Creating gift loops for charitable causes (GiftLoop is for personal gifting only)
- Requesting contributions for medical expenses, emergencies, or causes
- Using the platform for commercial fundraising
- Creating multiple accounts to circumvent platform rules
- Attempting to manipulate or game the system
9. Termination
We reserve the right to suspend or terminate your account at any time for violation of these terms, fraudulent activity, or any other reason at our discretion. Upon termination, you will forfeit any outstanding funds unless legally required otherwise.
10. Disclaimers
GiftLoop is provided "as is" without warranties of any kind. We do not guarantee:
- Uninterrupted or error-free service
- That you will reach your funding goals
- The accuracy of information provided by other users
- That contributors will follow through with their intended contributions
11. Limitation of Liability
To the maximum extent permitted by law, GiftLoop and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability will not exceed the fees you paid to GiftLoop in the past 12 months.
12. Changes to Terms
We may modify these Terms of Service at any time. We will notify you of material changes via email or through the platform. Your continued use after changes indicates acceptance of the new terms.
13. Governing Law
These terms are governed by the laws of the jurisdiction in which GiftLoop operates, without regard to conflict of law principles.
